- Session behavior — Mouse movements, clicks, and scroll patterns recorded by Microsoft Clarity (see Session Recording section below). No personally identifiable information is captured.
How We Use Your Information
- Respond to your inquiries — When you ask about a listing, request a value estimate, or submit a form, we use your info to get back to you
- Process financing — Credit application data is sent securely to our lending partners for pre-approval and financing decisions
- Follow up on leads — If you express interest in buying, selling, or trading, our sales team may follow up via phone, email, or text
- Send text messages — Appointment reminders, listing alerts, and follow-ups (with your consent — see SMS section below)
- Improve our website — Analytics and session recording data helps us understand what pages work and what doesn’t
- Marketing — Retargeting ads on Google and Facebook based on your browsing activity (you can opt out — see below)
How We Protect Your Data
We take data security seriously — especially financial data.
- Credit applications are encrypted using AES-256-GCM encryption, the same standard used by banks and financial institutions. Your SSN and financial data are encrypted at rest and in transit.
- Our website uses SSL/TLS (HTTPS) for all connections
- Access is restricted — Only authorized team members can view sensitive data, and only as needed
- We don’t store credit card numbers — Payments are processed through secure third-party processors
Text Messaging (SMS) Policy
We use text messaging to communicate with customers who opt in. Here’s how it works:
- Consent required — We only text you if you’ve given us permission (by submitting a form with SMS consent, texting us first, or verbally agreeing)
- What we send — Appointment confirmations, listing alerts, follow-ups on your inquiry, and occasional promotions
- Frequency — Varies, but typically 1-5 messages per month
- Opt out anytime — Reply STOP to any message. We’ll confirm and stop immediately. No questions asked.
- Message and data rates may apply depending on your carrier and plan
- We never sell your phone number to third parties for marketing purposes

We only share your data when necessary to provide our services:

Session Recording & Behavior Analytics (Microsoft Clarity)
We use Microsoft Clarity, a behavior analytics service, to understand how visitors interact with our website. Clarity records anonymized session data including:
- Mouse movements and clicks — Where you move your cursor and what you tap or click
- Scrolling behavior — How far down pages you scroll and where you stop
- Heatmaps — Aggregate patterns of where visitors focus attention on our pages
What Clarity does NOT collect:
- Personally identifiable information (name, email, phone)
- Passwords, credit card numbers, or financial data (these fields are automatically masked)
- The content of any form fields you type into
This data is used solely to improve website usability — for example, identifying pages where visitors get confused or where buttons aren’t working as expected. Session recordings are accessible only to The Boat Broker team and are not shared with third parties for marketing purposes.

Your Rights
You have the right to:
- Access — Request a copy of the personal data we have about you

Data Retention
- Lead/inquiry data — Retained for up to 3 years for follow-up purposes, then archived or deleted
- Credit application data — Retained per financial regulatory requirements (typically 5 years), then securely destroyed
- Transaction records — Retained as required by Arizona law and IRS regulations
- Website analytics — Aggregated data retained indefinitely; personal identifiers expire per Google/Meta policies
- Session recordings (Clarity) — Retained per Microsoft Clarity’s default retention period (13 months), then automatically deleted
Children’s Privacy
Our website and services are not directed at individuals under 18. We do not knowingly collect personal information from minors. If you believe a minor has submitted information to us, please contact us and we will delete it promptly.

Conversion Tracking and Marketing Data Sharing
The Boat Brokers, Inc. uses two privacy-protective methods to measure advertising effectiveness: a browser-side Meta Pixel and a server-side Meta Conversions API (CAPI) integration, both operated by Meta Platforms, Inc. ("Meta").
What we send. When you view a listing or submit a lead form on our website, our server may transmit to Meta a SHA-256 hashed version of one or more of the following: your email address, phone number, first name, last name, IP address, and browser user agent. These values are hashed (converted to a one-way cryptographic digest) before transmission — The Boat Brokers, Inc. does not store the hashed identifiers on its own servers. We also transmit non-identifiable event metadata: the type of action taken (e.g., “viewed listing,” “submitted inquiry”), a timestamp, and a reference to the relevant listing.
When we send it. For events that include personally identifiable information (email, phone, name), we transmit hashed data to Meta only when you have explicitly opted in via the consent checkbox on our lead capture forms. For page-view and content-view events that do not involve form submission, we transmit only your IP address and browser user agent — no name, email, or phone is sent for those events.
Why we send it. Meta uses this information solely for ad measurement and attribution — to evaluate whether our advertising is reaching people who are genuinely interested in boats and to show relevant ads on Facebook, Instagram, and Meta’s audience network. We do not authorize Meta to use this information for its own product development or to sell it to third parties for purposes unrelated to our ad measurement, consistent with Meta’s Business Tools Terms (https://www.facebook.com/legal/businesstools/). Transmission is governed by Meta’s Privacy Policy (https://www.facebook.com/privacy/policy/).
Your choices. You may opt out of Meta’s use of your data for ad personalization by adjusting your Ad Preferences in your Facebook account (https://www.facebook.com/adpreferences/). Opting out of our TCPA consent checkbox at form submission prevents us from sending your hashed identifiers to Meta for that inquiry. To request that Meta delete event data associated with your identifiers, submit a deletion request to us using the form at /privacy-policy/#deletion — we will forward the request to Meta and document our outreach.
Data retention. The Boat Brokers, Inc. does not store hashed identifiers generated for Meta CAPI transmission. The hash is computed at request time, transmitted, and discarded — it is not written to any TBB database. Meta’s own retention of event data is governed by Meta’s Privacy Policy and Data Deletion Policy; TBB has no control over Meta’s retention timeline once data is transmitted.
California Consumer Privacy Rights (CCPA / CPRA)
This section applies to California residents and supplements the rest of this Privacy Policy. It is provided pursuant to the California Consumer Privacy Act of 2018 (CCPA) as amended by the California Privacy Rights Act of 2020 (CPRA). References to "personal information" below have the meaning given in the CCPA.

We do not sell your personal information to data brokers. The disclosures to Google and Meta above may constitute a "sale" or "sharing" of personal information under the CCPA because those companies may use the data for their own purposes (cross-context behavioral advertising). You have the right to opt out of this use — see below.
Third-Party Advertising & Your Opt-Out
If you click "Do Not Sell or Share My Personal Information," we will stop transmitting your browsing data to Meta (Facebook Pixel), Microsoft Clarity, and Google advertising services. This takes effect immediately on your next page view. Server-side conversion data sharing is also suppressed.
Session recordings collected through Microsoft Clarity may be associated internally with lead inquiry records (such as a contact name or phone number you submit through our site) to allow our sales team to review the session in which an inquiry was received. This association is reflected within your Clarity session dashboard (hosted by Microsoft) using only that identifier; no name, contact information, or other personal details are transmitted to Microsoft Clarity. Visitors who opt out of analytics data collection through our Do Not Sell or Share link will not have session recordings collected or linked.
Your California Privacy Rights
If you are a California resident, you have the following rights:
- Right to Know — Request disclosure of the categories and specific pieces of personal information we have collected about you, the sources, and with whom it has been shared.
- Right to Delete — Request deletion of personal information we have collected, subject to certain exceptions.
- Right to Correct — Request correction of inaccurate personal information we hold about you.
- Right to Opt Out of Sale / Sharing — Direct us to stop selling or sharing your personal information with third parties for cross-context behavioral advertising. Use the link below to submit this request.
- Right to Limit Use of Sensitive Personal Information — Limit our use of sensitive personal information (such as SSN / DOB collected in a credit application) to purposes reasonably necessary to provide the requested service.
- Right to Non-Discrimination — We will not deny service, charge a different price, or provide a different level of quality because you exercised any of these rights.

Right to Know / Delete / Correct requests: We will respond within 45 days of receipt. We may extend by an additional 45 days where reasonably necessary, with prior notice. No fee unless a request is manifestly unfounded or excessive.
Right to Opt Out requests: We will process opt-out requests as soon as feasibly possible and no later than 15 business days from receipt, consistent with California law.
We will verify your identity before processing a deletion or know request. Verification may require you to provide information that matches what we have on file. You may designate an authorized agent on your behalf — the agent must provide written authorization signed by you.
Do Not Sell or Share My Info →Persistent Customer Profile (Dossier) — Disclosure
We maintain a persistent profile of your interactions with our website and communications over time. This profile is used by our sales team to personalize follow-up communications about boats and related products you have shown interest in. The profile accumulates information from each visit you make to our site, including on return visits, and from each communication channel through which you contact us (email, text message, phone call, website chat, social media messages). This profile is linked to a unique identifier assigned to your browser on your first visit and, if you later provide your name and contact information, to your personally-identified record in our customer relationship system.
We retain identified customer profiles for up to two years from your most recent interaction with us, or for such longer period as may be required by applicable law (including legal requirements to retain transaction and consignment records). If you have not interacted with us for two years, your behavioral and engagement data will be purged or de-identified; your contact information and transaction records may be retained for the period required by law.
We do not currently obtain information about you from third-party sources. If we do so in the future (for example, to verify a vessel you identify as a trade-in or consignment), we will update this disclosure before doing so. You may request that we disclose the categories of personal information we have collected about you.
Right to know: You may request a summary of the personal information we hold about you, including behavioral and engagement data accumulated in your customer profile. We will provide this summary within 45 days of a verified request. Right to delete: You may request deletion of your customer profile. We will delete your profile data (other than records we are required to retain by law) within 45 days of a verified request. If you have contacted us through Facebook Messenger or Facebook Marketplace, we may receive and store certain information provided by Facebook in connection with that interaction, including your Facebook display name, profile picture, locale, gender, and (where you initiated contact about a specific listing) the listing you messaged about. This information is categorized under California law as "inferences drawn from your social media account information to create a profile." You may request deletion of this information at any time using the contact information above.
First-Party Behavioral Tracking & Identity Stitching
The Boat Broker operates first-party tracking software on this website that records which listings and pages you view, how long you spend on each page, whether you interact with financing calculators or forms, and your approximate location (if you grant browser geolocation permission). This data is stored in our own database — it is not shared with advertising platforms and is not used for cross-context behavioral advertising. Its sole purpose is to allow our brokers to follow up with you about listings you have shown interest in.
When you submit a form on our website (inquiry, credit application, consignment intake, or similar), we associate your prior anonymous browsing history on this device with your identity. This means that listing views, calculator interactions, and time-on-page data collected before you introduced yourself may be linked to your lead record and visible to our sales team. You may opt out of this first-party behavioral tracking at any time using the “Do Not Sell or Share” link above or by submitting a deletion request.
Google Consent Mode v2
The Boat Broker uses Google Tag Manager with Consent Mode v2 on this website. Analytics and advertising storage begin in a denied/restricted state on every page load. If you acknowledge this notice and have not submitted a “Do Not Sell or Share” opt-out request, and if no Global Privacy Control signal is detected on your browser, this website’s consent layer updates analytics and advertising storage to granted — enabling Google Analytics 4 (audience measurement), Google Ads conversion measurement, and related advertising features operated by Google LLC.
